Terms of Service

1. Acceptance of these terms

By downloading, accessing, or using the Service you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 16 years old to use Merchant. By using the Service you confirm that you meet this requirement and that the information you provide is accurate.

3. Your account

You sign in using Google. You are responsible for activity that happens under your account and for keeping your sign-in method secure. Let us know promptly if you believe your account has been compromised.

4. Licence to use the game

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own enjoyment, subject to these terms. We retain all rights not expressly granted to you.

5. Acceptable use

When using Merchant, you agree not to:

• Cheat, exploit bugs, or use bots, scripts, or modified clients to gain an unfair advantage.
• Falsify or spoof your device location.
• Reverse-engineer, decompile, or attempt to access the Service’s source or servers without authorisation.
• Disrupt, overload, or interfere with the Service or other players.
• Harass other players or post unlawful, abusive, or infringing content.
• Use the Service in violation of any applicable law.

6. Playing in the real world

Merchant is played in real-world locations. Always be aware of your surroundings and play safely. Do not play while driving, do not trespass on private property, and obey all local laws. You are solely responsible for your conduct and safety while playing.

7. Virtual items & purchases

The Service may offer optional in-app purchases. Virtual goods and currency have no real-world monetary value, cannot be exchanged for cash, and are licensed to you — not sold. All purchases are processed by the Apple App Store or Google Play and are subject to their terms. Refunds, where available, are handled by the relevant store under its policies.

8. User content

Any names, settlements, or other content you create remain yours, but you grant us a worldwide, royalty-free licence to host and display that content as needed to operate the Service. You are responsible for the content you create and must have the rights to it.

9. Intellectual property

The Service — including its code, artwork, names, logos, and design — is owned by us or our licensors and is protected by intellectual-property laws. You may not copy, distribute, or create derivative works from it except as these terms allow.

10. Availability & changes

We work to keep the Service running, but we do not guarantee it will always be available or uninterrupted. We may add, change, suspend, or remove features at any time, and may perform maintenance that temporarily affects access.

11. Suspension & termination

We may suspend or terminate your access if you breach these terms or use the Service in a way that harms us or other players. You may stop using the Service and delete your account at any time.

12. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be error-free, secure, or uninterrupted.

13. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages, or for loss of data or in-game progress, arising from your use of the Service. Nothing in these terms limits liability that cannot be limited under applicable law.

14. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service or your breach of these terms.

15. Governing law

These terms are governed by the laws of [jurisdiction — e.g. the Netherlands], without regard to its conflict-of-law rules, and the courts of that jurisdiction will have exclusive authority, except where mandatory consumer-protection law provides otherwise.

16. Changes to these terms

We may update these terms from time to time. We will revise the “Last updated” date above and, for material changes, provide a more prominent notice. Continued use of the Service after changes take effect means you accept the updated terms.
